By participating in the Power Listing’s Affiliate Program, you agree with the terms and policies set forth in the Agreement below. Please read the entire Agreement. It is a legal agreement between you and Power Listing. By submitting the online application, you are agreeing that you have read and understand the terms and policies of this Agreement, and that, if Power Listing accepts your application, you agree to be legally responsible for each and every term and policy. Power Listing reserves the right to deny or accept any application at its sole discretion.
This AFFILIATE AGREEMENT (the “Agreement”), made and entered into by and between Power Listing Inc. (“Power Listing,” “Principal,” “us,” “our,” or “we”), a Florida Corporation, with its principal place of business located at 9181 Bradleigh Drive, Winter Garden, FL 34787, and the Power Listing’ Affiliate (“Referrer,” “you,” or “your”). This legally binding agreement contains all the terms and conditions that apply to your participation in the Power Listing’s Affiliate Program (“Power Listing’ Affiliate Program,” “Affiliate Program” or “Program”).
We greatly value and appreciate those who recommend and promote our services and products to others. If accepted into the Power Listing’s Affiliate Program we will create a custom landing page featuring your business name, branding, and a potential discount on our subscription service.
Affiliates are paid a fixed percentage (25%), as agreed between the parties and stated in writing, for each confirmed paid referral they make that is not canceled or refunded, so long as you remain an affiliate and this agreement is in effect. The paid referral is valid on new subscriptions on a plan created specifically for Affiliates.
Affiliates shall be responsible for all taxes and other similar levies as required by any law or regulation. Affiliate agrees as a condition of payment to accurately provide all identification and tax information necessary to allow us to comply with legal requirements.
The cost of our products and services may change at any time and without notice. The affiliate payment for our products and services may change at any time and without notice. There is no guaranteed minimum payment from any referral.
Violations of Power Listing Terms of Service will qualify your account for immediate cancellation.
The ability to advertise our products and services as an affiliate is non-exclusive and revocable at our discretion for any reason.
All proprietary information, trademarks, copyrights, and all other similar rights in and arising out of our products and services are and shall continue to be, our exclusive property. Affiliates have a right to refer to our trademarks only so long as they remain active affiliates and otherwise comply with these terms.
Affiliates shall act exclusively as independent contractors and are not an employee or an agent. Nothing in this Agreement shall create a partnership, joint venture, agency, or franchise between the parties. Affiliates shall not sign any document in our name or on our behalf, nor shall any affiliate hold itself out as being our agent or as having apparent authority to contract for or bind us to any contract.
Affiliates may not promote our products or services from any website or other location that engages in illegal conduct, according to both law of the jurisdiction where we are based and the law of the jurisdiction in which the affiliate resides.
Affiliates are prohibited from taking any action, using any practice or technology, which interferes with our website and/or tracking of referrals or affiliate commissions. This includes the use of toolbars, download technology, cookie stuffing, and any other system, practice, or scheme which results in a non-user-caused event that creates a commissionable event.
We reserve the right to make the final decision on whether a commission falls into one of these categories. Any affiliates found breaking these terms will be permanently banned and any pending commissions will not be paid out.

What information is required to become an affiliate?
Do I earn a commission on every purchase?
We provide commissions for the lifetime of the customer so that affiliates have unlimited earning potential. In order to earn 25% commission from every referral, the user must purchase a service after clicking on our offer from your personalized affiliate page. Any user cancellations and refunds will have the commission retracted from the affiliate account.
How often is the commission paid?
An Affiliate audit is completed during the first week of the month directly following the month we’re auditing (e.g., an affiliate audit for January is completed during the first week of February). If your commission total reaches the minimum of $200 during your audit your commission payout will be processed via PayPal. Please note: the total commission received will reflect the total earned minus any third party processing fees.
How do you track conversions?
When someone clicks your unique link, cookies are added to their browser to track whether or not they make a purchase on Power Listing. If that user signs up for any one of our plans – not just the one on your landing page – after clicking your affiliate link, your account will be credited. If the user purchases anything else on Power Listing, your account will be credited.
Affiliates understand that payment tracking can never be 100% accurate and this may be affected by events beyond our control, such as customers not accepting cookies or other mechanisms through affiliate referrals through which affiliate referrals are tracked.
